General Conditions

Please read this Agreement carefully before accessing or using the Site. If you do not agree to all the terms and conditions of this agreement, please immediately discontinue to use the Site.

Ownership and Copyright

You acknowledge that any and all information, content, reports, data, databases, graphics, interfaces, web pages, text, files, software, product names, company names, trade-marks, logos and trade names contained on this web site (collectively the "Content") including the manner in which the Content is presented or appears and all information relating thereto, are the property of their respective owners as indicated, the Company or its licensors, as the case may be.

Third parties are expressly forbidden from engaging in any unauthorized methods such as automated systems, deceitful practices, or irregular procedures to copy, scrape, or extract data from our site. This prohibition extends to all forms of replication, downloading, commercializing, trading, or reselling our text, images, and other materials. Actions that aim to exploit our resources for any commercial or financial benefits outside the sanctioned usage of our services are considered a significant breach of these terms. Such conduct may lead to legal measures to safeguard the interests and assets of Exposure Events.

Modifications of Terms

We reserve the right to change these Terms at any time. If the alterations constitute a material change to the Terms, we will notify you to your email address.

What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment. If you don't agree with the modifications made, please immediately discontinue to use the Site and ask for the cancellation of your profile and the removal of data regarding you. Continue to use the Site will be interpreted as an implied acceptance of the changes.

Account Information Sharing

Any information collected under an account during the time with Exposure Events will "not" be shared or sold outside that account to advertisers, competitors, or any type of third party. All account data belongs to that specific account unless shared with another account which the main account has gave consent to. Exposure Events may target data that will help promote their tournament management system and tools, but no other entity outside of it.

Severability

Each provision of these Terms shall be construed separately and independently. If any provision is deemed invalid, void or otherwise unenforceable, it shall be deemed severable from the other and shall not affect the validity or enforceability of the remaining provisions of these Terms.

Description of Service

Exposure Events enables its users ("You") to manage and follow events. In the event site created with Exposure Events (the/your "Content") you can manage all information.

Registration

In order to try Exposure Events Service you must provide an username and a password and other information as prompted by the registration process. You are responsible for maintaining the confidentiality of the password and are fully responsible for all activities that occur under your account. Your username and other personal data must remain valid as long as your Exposure Events account remains active and it is your responsibility to update them if they should no longer be accurate or current.

If a custom app was created for a member and that member wants to transfer the app to another system a transfer fee is required.

You can delete your Exposure Events account at any time. Deactivating your account will permanently remove all your data from Exposure Events.

Event directors are required to have a single account with Exposure Events. If duplicate accounts are created the director risks being banned from our site. A warning will be sent but if repeated offenses occur the director will be banned.

Payments

You may buy credits to use Exposure Events, as explained on the Pricing page of our website. The number of credits needed for one or more events will depend on the number of teams. Buying Exposure Events's credit is available only if you are at least 18 years old. If you are a minor you can buy credits only with the consent of your parents or of your legal guardian.

Exposure Events credits never expire. You can find more details about the credits you've bought and the way you are using them in your profile at the section "Orders". Credit discounts may not be shared between organization accounts.

Exposure Events credits are normally not refundable. In other circumstances we are required to provide a refund only if we terminate our Service to you without cause before the end of a event for which you have paid. Pricing may change without notice, please check our Pricing page to have the most updated credits cost. You can use an active event only once. We may, at our sole discretion, offer refunds in other situations subjected by any registered user.

Exposure Events works with third party systems that may change terms, rules or guidelines that might impact customers. If a user purchased a service that was effected by a third party change, Exposure Events will try to accommodate the user by working around the change but the original purchase is not refundable.

Contributor's conduct and responsibility

You warrant that your use of the Website will be in strict accordance with our Privacy Policy, with this binding Agreement, with all laws and regulations, including local ones in your home country.

It is against our policy to create multiple accounts for the same organization. If we find a user creating multiple accounts on our site they risk being banned from using our services.

It is against our policy to reuse the same teams for an event that had ended that already have credits applied to them. New events must be created with new teams. You risk being banned if we find out this is occurring and do regular checks throughout the year.

You are solely and entirely responsible for all Content that you publish.

Exposure Events does not control, and is not responsible for your Content and Third-Party Content and may not be held liable for their communication to the public.

Removal or hiding of the "powered by Exposure Events" text requirement on our widgets or other provided visual content.

By making Content available to others, you also warrant that:

• the Content is not unlawful, obscene, harmful, or defamatory and does not contain threats towards any person or entity;
• the Content does not violate the privacy or publicity rights of any third party and does not to publish any unsolicited or unauthorized advertising, promotional materials;
• the Content is not spam, is not machine-generated, and does not contain unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites;
• the event is not named in a manner that misleads your readers into thinking that you are another person or organization;
• the Content is correct, appropriate and isn't misused to gain exposure over others;
• you won't engage in any conduct or to post or share any that would interrupt, limit or more generally harm the Site and/or the Service or enable you to gain unauthorized access to the Site, including by using viruses, malicious computer code, programs or files;
• you won't reproduce, copy, sell, or commercially use (including the right to access) in whole or in part, the Service and/or Site.

In case of any violation of the above, Exposure Events reserves the right to cancel or rename your account and/or to block you from accessing the Site as well as to disclose any information as necessary to satisfy any law, regulation, governmental request or partner request, at its sole discretion. Exposure Events also reserves the right to delete your Tournaments and/or to block the distribution of Your Content or any Third-Party Content through the Service and/or to modify, at its sole discretion, the name of your Tournaments.

Personal Data and Privacy Policy

You acknowledge and agree that Exposure Events may, in its sole discretion, preserve or disclose your Content, as well as your information, such as email addresses, IP addresses, time-stamps, and other user information, if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to: comply with legal process, enforce these Terms, respond to claims that any Content violates the rights of third-parties, or protect the rights, property, or personal safety of Exposure Events, its users, or the general public.

Communications

In the course of providing you services, Exposure Events may send you notices via email, or display on the Site links to said notices. For instance, Exposure Events will use the email address you provide to register you to use our Service, to verify your authority to use certain features of our Site and Service, to deliver certain services and notices based on the email settings you have selected, to improve and tailor the content and general administration of our Site and Service.

Limitation of Liability

In no event will Exposure Events, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for:

• interruption of use or loss or corruption of data; for any loss of data or any harm to Your Content, your Tournaments, your computer system or any other electronic device.
• any use or misuse of Your Content or services made by a third party or a commercial partner, or more generally for the conduct of others.
• inaccuracies, errors, bugs, or interruptions.

In addition, Exposure Events reserves the right to:

• modify or terminate all or any portion of the Service for any reason, without notice at any time.
• remove Content and accounts containing Content that we determine in our sole discretion are unlawful, obscene, threatening or defamatory, or violates any party's intellectual property or these Terms.

Exposure Events's services are provided "as is" with no warranty, express or implied, of any kind and Exposure Events expressly disclaims any and all warranties and conditions. In addition, Exposure Events expressly disclaims any and all representations and warranties that any events or matches will occur.

Exposure Events has no control over and does not host Third-Party Content and Third-Party Services. Similarly, we cannot control links to other websites or other Internet resources. These resources, content and services are provided to you "as is" to facilitate your web browsing. So remember that Exposure Events may not be held liable with respect to third-party resources, content or services and you undertake to directly and exclusively contact the appropriate third party with any claim or request you may have.

Exposure Events lists independent freelance event schedulers but in no way are they affiliated with Exposure Events. An event director and freelance scheduler agree that the freelance scheduler is performing services as an independent contractor and that freelance scheduler is not an employee or agent of Client or Exposure Events. Freelancer will perform the Freelancer Services in a professional and workmanlike manner and will timely deliver any agreed upon Work Product. The manner and means of performing the Freelancer Services will be determined and controlled solely by Freelancer, which is engaged by Client as an independent contractor.
